In summer 2008 the Ministry of Education and Science (MEC) prepared a draft royal decree that would serve to deliver the Level C . This draft is not yet approved . However, if adopted, would not solve most of the problems generated by the Royal Decree 1629/2006.

Regulations Summary affecting EEOOII:
Ministry of Education: State scope.
- Education Law 2 / 2006, of May 3 = Set for EEOOII three levels: Basic, Intermediate and Advanced.
- Royal Decree 1629/2006 of 29 December (BOE of January 4, 2007) = Set to the Advanced level only corresponds to a B2. Approves the Certificate of Fitness, only a B2.

Ministry of Education of the Community of Madrid: regional scope.
- Decree 31/2007 of 14 June (BOCM of June 22, 2007) = Set in the Community of Madrid, there will be 6 courses to reach the advanced level (Arabic, Chinese and Japanese have 8 courses) Level maximum = B2

situation from 2007/2008: Negative consequences of Royal Decree 1629/2006 against which collected over 16,000 signatures:
- Devaluation of the Certificate of Fitness (5 º of the old plan) Corresponding single level B2
- Advanced Certificate Equivalency only B2 level.
- Unique opportunity to obtain the level C = private.
- Each Autonomous Region, distribution of courses and different content.
- only ensures an annual call for certification (this could take the September exam, as they have done in other Communities)
